Terms and Conditions
1. Definitions
You - the customer a person or company buying or using eoutlet.co.uk.
Products Consumer - a person buying Products for their own use. Business Customer
- a company with a network. eoutlet.co.uk (us, our) - the Product vendor as identified
on your invoice. Order confirmation acknowledgement of Product ordered by you, sent
by eoutlet.co.uk. Price stated in Order Confirmation Product as described in Order
Confirmation
2. Application
This Agreement applies to this sale and all statements made by eoutlet.co.uk
in brochures, price lists, adverts, quotations, on the internet or verbally. Variations
to this Agreement must be made by eoutlet.co.uk in writing. Any other Terms and
Conditions are excluded. Placing your order means acceptance of this Agreement.
eoutlet.co.uk may change this Agreement at its choosing.
3. Orders/Contract
Orders are accepted via the Internet only and are only binding when
accepted by eoutlet.co.uk and eoutlet.co.uk sends out the Order Confirmation by
e-mail. Please check the Order Confirmation and notify eoutlet.co.uk of any mistake
by e-mail immediately or the details stated in the Order Confirmation will apply
to this Agreement.
4. Price & Payment Terms
eoutlet.co.uk reserves the right to change Products at any time but
eoutlet.co.uk guarantees you at least equivalent functionality and performance.
eoutlet.co.uk endeavours to provide the lowest prices available on the web and will
match any bona fide price available on another supplier's website providing they
have stock. A price match will only be considered on a like for like basis. We will
consider any price match requests providing the other supplier's identifying part
code is entered on the request and that the full web address is provided. We will
decline to match any prices without this information. Any requests to match such
prices shall be made prior to order acceptance by e-mail. Once an order has been
accepted, the agreed price shall not be modified. We reserve the right to not or
refuse to price match if item would be below our cost. Price excludes tax and shipment.
Exchange rates, duties, insurance, freight and purchase costs (incl. for components
and services) may cause eoutlet.co.uk to adjust prices. Payment will be made before
supply by Credit Card only. eoutlet.co.uk may suspend deliveries or service until
full payment has been secured.
5. Voucher/Discount Codes
Voucher codes are limited to one use per customer and for single purchases
only. Voucher codes are not valid in conjunction with any other offer. For offer validity, refer
to the dates specified on the unique voucher. Voucher codes cannot be redeemed retrospectively.
eOutlet reserves the right to withdraw the offer at any time, without prior notice.
6. Delivery/Title/Risk
The goods you order will be delivered to the address you give when
you place your order, except that some deliveries are not made outside the United
Kingdom. The Supplier reserves the right to refuse delivery to an address which
is not the address of the credit/debit card holder. Every effort will be made to
deliver the goods as soon as possible after your order has been accepted. However,
the Supplier will not be liable for any loss or damage suffered by you through reasonable
or unavoidable delay in delivery. Time for delivery shall not be of the essence
and delivery by instalments may be made. The goods may be delivered by the Supplier
in advance of the quoted delivery date. Upon receipt of your order you will be asked
to sign for the goods received in good condition. If you are unable to check the
contents of the package at that moment in time please sign for the parcel as "UNCHECKED".
Failure to do so may affect any claims that you make thereafter. The customer shall
report any damage or shortage to eoutlet.co.uk via the Internet in writing within
7 days of delivery. Provided prompt notice of transit damage or loss is given and
provided it is proved to the Supplier's satisfaction that such damage occurred in
transit in the UK but not otherwise, the Supplier will refund, repair or replace
such equipment free of charge to the customer. Title to Product does not pass until
full payment in cleared funds has been received for all goods delivered to the buyer
under this and all other contracts between the seller and the buyer. Until then
you must insure and store our goods separately and you may not modify, pledge or
sell them. eoutlet.co.uk may enter the storage premises to repossess the goods.
Should you sell them before title passes, you will become eoutlet.co.uk's agent
and the proceeds of the sale shall be held on our behalf, separately from your general
funds. eoutlet.co.uk may sue for the Price before title passes. If you refuse delivery
without eoutlet.co.uk's agreement, you must pay eoutlet.co.uk's expenses or loss
resulting from that refusal, including storage costs, until you accept delivery.
7. FM Transmitters
You shall indemnify eoutlet.co.uk against all liabilities in
respect of any matter arising out of or in connection with the purchase of an FM
Transmitter. eoutlet.co.uk shall not be liable for any loss damage claim or
expense arising out of or in connection with the purchase of an FM Transmitter.
FM Transmitter's are illegal to be used within the UK and if You use one within
the UK, You will be using it at Your own risk. eoutlet.co.uk will note
take any responsibility whatsoever. We recommend You only use this item abroad
in countries where the use of this item is not prohibited.
8. Acceptance
When you receive the Product you must inspect it within 7 days. After
this period, you will have accepted the Product. If eoutlet.co.uk agrees to the
return of the Product at its choosing, it must be in its original condition with
packaging, with a eoutlet.co.uk issued Return to Manufacturer Authorisation (RMA)
and proof of purchase; the return costs may also be payable by you.
9. Returns
Before returning any items(s) to eoutlet.co.uk please ensure that
you have: Clearly marked on the outside of the package the RMA number as stated
in the top right hand corner of the RMA document. Please do not write directly on
the box/packaging, attach a separate label. Enclosed all items originally supplied
with the returnable product, unless informed otherwise. Used all of the original
packaging to return the goods. Ensured the eoutlet.co.uk address is clearly displayed.
Ensured the goods are securely packaged and sealed. Returned the goods via an insured
method i.e Recorded delivery which records you sending it and requires a signature
on receipt. eoutlet.co.uk cannot accept responsibility for any goods until they
have been signed for by a eoutlet.co.uk member of staff. Failure to follow this
procedure may result in your return being rejected.
10. Distance Selling Regulations
Distance Selling regulations allow for a cooling off period of 7
days from receipt of goods covered under the legislation. Customers may return specified
goods without reason within this period for a refund. This excludes goods made to
the consumer's specifications. It does not apply to goods intended for everyday
consumption. Video recordings or computer software unsealed by the consumer are
also excluded. The cost of returning and appropriately insuring the goods until
satisfactory receipt at eoutlet.co.uk will be borne by the customer. To cancel the
contract, an RMA request must be received via the website at www.eoutlet.co.uk within
7 working days of receipt of the goods. Delivery is deemed to be completed on the
day after receipt of the goods. The customer will be required to return the goods
in its original condition with packaging, before a refund can be processed. Following
receipt of written rejection the customer will be sent a RETURN TO MANUFACTURER
number within 5 working days via e-mail. This number must be quoted on all returned
goods so that the goods can be properly identified. The company cannot be held responsible
for goods returned without proper identification. It is the customers responsibility
to ensure the safe return of the goods and the goods will be deemed as returned
upon inspection and confirmation that they are in good order by eoutlet.co.uk. A
refund will be issued within 30 days of satisfactory receipt of the goods at eoutlet.co.uk.
Refunds will be by payment to the originating credit card. The Regulations do not
apply to used goods and unsealed licensed. eoutlet.co.uk will deduct from any refunds
the transit delivery charges incurred by eoutlet.co.uk If you have any questions
or complaints regarding the company, please write to the Customer Care Manager.
The company will endeavour to acknowledge written complaints within 5 working days.
The time it takes to reach complete resolution of complaints will be governed by
the nature and complexity of the issue but we will endeavour to ensure that consumers
are informed of the progress of complaints as appropriate. Details of the specification,
price and arrangements for payment of the goods purchased by distance selling are
available on our web site, in our company publications and will also be provided
on invoices despatched with your order. You are advised to print out your web order
for your records. Details relating to the warranty of products purchased from eoutlet.co.uk
will be as detailed on the website at the time of order. These details form part
but are not the exclusive extent of your contract with eoutlet.co.uk which is governed
under English law. Your statutory rights as a consumer are unaffected.
11. Liability
eoutlet.co.uk does not accept liability for 1) indirect or consequential
loss, 2) loss of business profits, salary, revenue, savings, 3) damage remedied
by eoutlet.co.uk within reasonable time, 4) loss avoidable by you through reasonable
conduct, including backing up all data and following eoutlet.co.uk's reasonable
advice generally, 5) all items excluded from the Warranty by Force Majeure
12. Software
Software not owned by eoutlet.co.uk is supplied subject to licence
and warranty of the Software licensor. eoutlet.co.uk enclosed the Software licence
that you require with the Product where necessary; you must comply with that licence.
13. Export Control
You acknowledge that Product may include technology and Software
which is subject to EU and US export control laws and laws of the country where
it is delivered or used: you must abide by all these laws. Product may not be sold,
leased or transferred to restricted end users or countries or for a user involved
in weapons of mass destruction or genocide. You acknowledge that EU and US restrictions
vary regularly and depending on Product, therefore you must refer to the current
EU and US regulations.
14. Force Majeure
eoutlet.co.uk is not liable for delays in performance (incl. delivery
or service) caused by circumstances beyond its reasonable control and will be entitled
to a time extension for performance; examples include strikes, supplier/transport/production
problems, exchange fluctuations, governmental or regulatory action and natural disasters.
If this lasts more than 2 months, this Agreement may be terminated by either party
without compensation.
15. Confidentiality
Each party must treat all information received from the other marked
"confidential" or reasonably obvious to be confidential as it would treat its own
confidential information.
16. Termination
eoutlet.co.uk may terminate this Agreement with written
notice if you: 1) fail to make payment in full within 14 days.
17. Your obligations as a Customer
You are responsible for; your
own choice of Product and its suitability for purpose; your telephone & postal
charges in contacting eoutlet.co.uk, if any.
18. Data Protection
Your data will be held and /or transferred in
strict accordance with the applicable data protection laws and eoutlet.co.uk's data
protection registration and you consent to this. You may instruct eoutlet.co.uk
not to use your data for direct marketing purposes.
19. Consumer Rights
Any statutory Consumer rights are unaffected
by this Agreement.
20. Jurisdiction
English law and the exclusive court jurisdiction
of the English courts will apply to this Agreement. The Vienna Convention on Contracts
for the International Sale of Goods is excluded.
21. Miscellaneous
If any part of the Agreement is found to be invalid
or unenforceable by a court, the rest is unaffected. eoutlet.co.uk may subcontract
its obligations to a competent third party. Otherwise, neither party may assign
or transfer any obligations or rights. All notices must be in writing (by hand,
email, fax or 1st class post deemed delivered 48 hours after posting) and sent to
a legal officer of either party. You can find all eoutlet.co.uk policies and notices
via www.eoutlet.co.uk and you should refer to this site for any further updates.
